1. Agreement to Terms

By accessing and using SACCO Reports Kenya ("Service," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

These Terms constitute a legally binding agreement between you and SACCO Reports Kenya.

2. Service Description

SACCO Reports Kenya provides background check reports on SACCO (Savings and Credit Cooperative) societies licensed in Kenya. Our reports include:

• SACCO licensing and regulatory status
• Publicly available information from SASRA and other official sources
• Contact information and basic organizational details
• Industry insights and regulatory analysis

3. User Eligibility

To use our Service, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete information
• Not be prohibited from using the Service under Kenyan law

4. Purchases and Payments

4.1 Pricing

Report prices are displayed in Kenyan Shillings (KES):

• Single Report: KES 100 per SACCO
• Pack of 10: KES 500 (KES 50 per report)
• Unlimited (11+ SACCOs): KES 1,000

Prices are subject to change with 30 days' notice. Current users will be notified of price changes.

4.2 Payment Processing

Payments are processed securely through Flutterwave. We accept:

• M-Pesa mobile money
• Credit and debit cards (Visa, Mastercard)

All payments are final unless otherwise stated in our Refund Policy (Section 6).

4.3 Report Delivery

Upon successful payment:

• Reports are delivered to your email within 5 minutes
• Reports are in PDF format
• Download links are valid for 30 days
• You may request re-delivery within 30 days at no additional cost

5. Data Accuracy and Limitations

5.1 Information Sources

Our reports are compiled from:

• SASRA (SACCO Societies Regulatory Authority) public records
• Official SACCO websites and public disclosures
• Licensed news sources and publications
• Public business directories

5.2 Data Freshness

We update our database regularly, but information may not reflect the most current status. Reports include a "last updated" date. Users should:

• Verify critical information directly with the SACCO
• Check SASRA's website for latest regulatory updates
• Consider the report date when making decisions

5.3 No Warranties

6. Refund Policy

6.1 Eligible Refunds

You may request a refund within 7 days if:

• Report was not delivered to your email
• PDF file is corrupted or unreadable
• You were charged incorrectly
• Technical error prevented report generation

6.2 Non-Refundable

Refunds will NOT be provided for:

• Change of mind after receiving report
• Dissatisfaction with publicly available information
• Reports that were successfully delivered and opened
• Duplicate purchases (please check your email before re-ordering)

6.3 Refund Process

To request a refund, email support@saccoreports.ke with:

• Transaction reference number
• Email used for purchase
• Reason for refund request

Refunds are processed within 7-14 business days to the original payment method.

7. Acceptable Use

7.1 Permitted Uses

You may use reports for:

• Personal research before joining a SACCO
• Due diligence for business purposes
• Educational and informational purposes
• Internal company use

7.2 Prohibited Uses

You may NOT:

• Resell, redistribute, or share reports without permission
• Use automated tools to scrape our website
• Copy, modify, or create derivative works
• Remove copyright or attribution notices
• Use reports for illegal purposes
• Defame or disparage SACCOs based solely on our reports
• Impersonate SACCO Reports Kenya or misrepresent affiliation

8. Intellectual Property

All content on our website and in our reports, including text, graphics, logos, and software, is owned by SACCO Reports Kenya and protected by:

• Kenyan copyright law
• International copyright treaties
• Trademark law

You receive a limited, non-exclusive, non-transferable license to view and use reports for personal/internal business purposes only.

You agree to indemnify and hold harmless SACCO Reports Kenya from any claims, damages, or expenses arising from:

• Your use or misuse of our Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or transmit

11. Termination

We may terminate or suspend your access immediately, without prior notice, if you:

• Violate these Terms of Service
• Engage in fraudulent activity
• Abuse or misuse the Service
• Provide false information

Upon termination, your right to use the Service will immediately cease. Previously purchased reports remain accessible per their download terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective:

• Immediately upon posting for non-material changes
• 30 days after notification for material changes

Continued use after changes constitutes acceptance. If you disagree with changes, discontinue use.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of Kenya, without regard to conflict of law principles.

13.2 Dispute Resolution

In case of disputes:

1. Informal Resolution: Contact us first at support@saccoreports.ke
2. Mediation: If unresolved, parties agree to mediation in Nairobi
3. Arbitration: Binding arbitration under Kenyan Arbitration Act
4. Court: Any legal proceedings shall be in courts of Nairobi, Kenya
